Captain Agreement

Until then it describes how Yott works today and applies to your use of Yott as written. Figures and some terms may change in the final version. Yott LLC’s Florida registration is pending state approval.

This is the agreement between Yott LLC (“Yott”) and each captain who lists on Yott (“you”). You accept it when you certify your listing on your dashboard. When our attorney’s final version replaces this draft, you’ll be asked to accept that version before your page stays live.

1. You are an independent business

You are an independent contractor, not Yott’s employee, agent or partner. You set your own trips, prices, schedule, availability and methods; you provide your own vessel, crew, equipment, bait and tackle; you decide how your trips are run; and you are free to take business from anywhere else. Yott provides a listing, a trip-request service and, once it opens, online booking and payment. Yott does not direct or control how you work.

You are responsible for your own taxes, including self-employment tax, and your own insurance and benefits. Once Yott pays you through its platform, Yott will issue the tax forms the law requires.

2. Your listing

You write your own page and are responsible for it. Everything on it must be true and current: your name and business, your boat, your trips and prices, your photos, your home port and any extra areas you run from, and your own payment, deposit and cancellation terms. You may hold one Yott account. Yott may edit or hide anything that breaks these rules or the law, and may remove a listing at any time.

You give Yott permission to show your listing content, including your photos, on getyott.com and in previews of your page. Yott won’t use your photos in its own marketing without your OK.

3. Your licenses, permits and insurance

You confirm that you and your vessel hold, and will keep current, everything the law requires for every trip you list, including:

  • a valid U.S. Coast Guard Merchant Mariner Credential appropriate to the trips you run, with a current medical certificate;
  • the Florida saltwater charter license (captain or vessel) covering the number of customers on your fishing trips;
  • federal charter/headboat permits for any trip in federal waters, and the HMS charter/headboat permit for trips that target tunas, billfish, swordfish or sharks;
  • vessel registration or documentation, required safety equipment including properly sized life jackets for every passenger, and compliance with your passenger limit;
  • commercial marine liability insurance that covers carrying passengers for hire, naming Yott LLC as an additional insured. Yott will publish minimum limits once they are set with counsel and its insurance advisor.

You upload copies of these documents and enter their numbers and dates. You will tell Yott within 7 days if any of them lapses, is suspended or changes. Yott reviews what you upload and may check it against public records, including the Coast Guard’s credential verification service and NOAA’s permit records. Yott’s review is not a guarantee of any document or of your compliance, and Yott relies on what you provide. When a license or permit lapses or is missing, the trips that need it are hidden from anglers; when your Coast Guard credential, medical certificate or insurance lapses, your page comes down until a current one is approved.

4. Trip requests and anglers’ contact details

Anglers send you trip requests on Yott, and you answer them on Yott. Yott shows you an angler’s first name and last initial, the request and the messages; you don’t receive the angler’s phone number or email address, and your own contact details don’t appear on your page or in messages. Yott hides phone numbers, email addresses, links and social handles typed by either side. You agree not to put your contact details on your page or in messages, and not to move a trip you found through Yott off Yott to avoid these terms or Yott’s commission.

Anglers who find you on Yott book with you through Yott. Once online booking opens, trips arranged on Yott are booked and paid through Yott. This applies while you list with Yott and for 12 months after your listing ends, for anglers Yott introduced to you. You will keep anglers’ information confidential and use it only for their trips.

5. Commission

Listing is free: no listing fee, nothing monthly. Yott earns a commission only on what you’re paid through Yott: completed trips booked through Yott, and any deposit you keep when an angler cancels late or doesn’t show. Nothing is charged until online payment is available; until then, anglers pay you directly and Yott charges nothing.

Your commission rate is set by the order in which captains first go live, and it never goes up while you list with Yott:

  • captains 1 through 25: 15%, locked;
  • captains 26 through 100: 18%, locked;
  • captains 101 through 500: 19%, locked;
  • captains after 500: Yott’s standard rate at the time, currently 20%.

Your place in that order is set the first time your page goes live. A suspension does not change it. Places are never reused. For each captain you invite who goes live on Yott, your rate drops one point, to no lower than 10%. Commission applies to trips booked through Yott; nothing is charged on trips you book yourself outside Yott with anglers Yott did not introduce.

6. Payment through Yott

Not in effect yet. Yott does not yet take payments. This section takes effect when Yott announces that online booking is open, and its final wording will be set by then.

When online booking opens, anglers pay for trips booked through Yott by card, through Stripe, into a Stripe account in your business’s name that you open through Yott. You are the seller: your business name appears on the angler’s card statement. At booking the angler pays a deposit of at least 25% of the trip price, or the deposit in your own terms if that is higher. Yott’s commission comes out of that deposit, and Yott covers the card fees on the deposit and the balance out of its commission, so you receive the trip price less your commission. The balance is charged to the angler’s saved card before the trip. Tips go straight to you; the card fee on a tip comes out of the tip. Refunds follow your posted cancellation terms and come out of your Stripe balance, as do chargebacks. When a trip doesn’t run and the angler is refunded, Yott returns its commission. When you keep the deposit after a late cancellation or a no-show, Yott keeps only your commission rate on that deposit and returns the rest. Before anglers pay through Yott, each passenger will sign a participation agreement and release of liability that names you, your vessel and crew, and Yott as released parties; Yott will provide a template you may adopt as your own.

7. Cancellations and conduct

Honor the trips you agree to. Cancellations within your control hurt anglers and Yott; repeated avoidable cancellations are reviewed by a person at Yott and can lead to suspension or removal. Cancellations for weather or safety are your call as master of your vessel and never count against you unless a person finds the reason was not genuine. Yott never decides whether conditions are safe.

8. Your responsibility to Yott

You will indemnify, defend and hold Yott harmless from any claim, loss, liability or cost (including reasonable attorneys’ fees) arising from your trips, vessel, crew, acts or omissions, or your breach of this agreement, including claims of injury or death to any passenger. Responsibility for the operation and safety of your trips rests with you, not Yott.

9. Ending this agreement

Either of us can end this agreement on 14 days’ notice; Yott may end it immediately for a breach, lapsed documents or insurance, or a safety concern. Trips already agreed and money already earned survive the end of the agreement.

10. Law and disputes

Florida law governs this agreement, along with U.S. maritime law where it applies. How disputes are heard (court or arbitration) and where will be set in the final version.

11. Changes

Yott may update this agreement. For a material change, including the final version from our attorney, you’ll be asked to accept the new version on your dashboard before your page stays live. The Terms of Service and Privacy Policy also apply to you.
