Terms of Service

Until then it describes how Yott works today and applies to your use of Yott as written. Figures and some terms may change in the final version. Yott LLC’s Florida registration is pending state approval.

1. Who we are and what these terms cover

Yott (getyott.com) is run by Yott LLC, a Florida limited liability company (“Yott”, “we”, “us”). These terms cover your use of the Yott website and services (the “Platform”). By using Yott, sending a trip request, joining the waitlist or creating a captain account, you accept them. If you don’t agree, please don’t use Yott.

Captains who list on Yott also agree to the Captain Agreement. How we handle personal information is in the Privacy Policy.

2. What Yott is, and isn’t

Yott is a marketplace where people who want to fish (“anglers”) find independent, licensed charter captains (“captains”) in Florida and send them trip requests. Yott is not a charter operator, boat owner or carrier. We don’t own or operate any vessel, employ any captain, or run any trip. Captains are independent businesses that set their own trips, prices, schedules and terms and run their own boats.

Any trip you take is an agreement between you and the captain, under the captain’s terms shown on his or her page. Yott is not a party to that agreement.

3. Who can use Yott

You must be 18 or older to send a trip request, join the waitlist or hold a captain account. Give accurate information and keep it current. Captains may hold one account each. You are responsible for what happens under your account.

4. Trip requests and messages

An angler sends a trip request from a captain’s page. The captain answers on Yott, and the two of you can exchange messages on Yott until the trip is arranged. A trip request is not a booking: nothing is reserved, and no money changes hands on Yott, until you and the captain agree.

To keep both sides’ contact details private, Yott hides phone numbers, email addresses, web links and social handles in trip requests, messages and captain pages, and shows anglers to captains by first name and last initial. Yott keeps the original text of messages for its own records. Message limits apply to prevent abuse.

Anglers and captains who meet on Yott agree to arrange their trips through Yott rather than taking the conversation elsewhere to get around it. Once online booking opens, trips arranged on Yott are booked and paid through Yott.

5. Prices, deposits and the captain’s terms

Each captain sets his or her own prices. Yott adds no booking fee on top of the captain’s price. A captain may have terms of his or her own, such as a deposit to hold a date, a card-payment fee, a cancellation window or a weather policy; those are shown on the captain’s page under “Payment and cancellation terms” and apply to your trip. Once online payment is available, captains pay Yott a commission on what they are paid through Yott, including a deposit a captain keeps after a late cancellation or a no-show; that is between Yott and the captain and is never added to your price.

Until online payment is available, payment, deposits, cancellations and refunds are between you and the captain, under the captain’s terms.

6. Online booking and payment

Not in effect yet. Yott does not yet take payments. The rules in this section take effect only when we announce that online booking is open, and the final wording will be set by then.

When online booking opens: you will pay by card, through our payment processor Stripe, to the captain’s business, which is the seller and the name on your card statement; you will pay a deposit of at least 25% of the trip price when you book, and the balance before the trip, charged to the card you booked with, which you agree to have saved for that purpose; tips are optional and go straight to the captain; the captain’s cancellation terms (or Yott’s standard policy, where the captain has none) will say what is refundable; and every passenger will sign the captain’s participation agreement and release of liability before the trip, with a parent or guardian signing for anyone under 18. If you ever dispute a charge, contact us first; we will set out a refund process and ask you to use it before contacting your card issuer.

7. Captains’ documents

Before a captain’s page goes live, Yott reviews copies of the documents the captain uploads: the U.S. Coast Guard credential (with its medical certificate date), certificate of insurance and, where the trips need them, the Florida saltwater charter license and federal fishing permits. We check them against public records where we can and may decline or remove a listing. “Documents checked” means we looked at copies of these documents on the date shown; it is not a guarantee that any document is valid, that a captain complies with the law, or of how a trip will go. Captains are responsible for their own licenses, permits, insurance, vessels and conduct.

8. What you may not do

  • Put phone numbers, email addresses, links or social handles in a trip request, message or captain page, or otherwise work around Yott to arrange a trip you found here.
  • Give false information, impersonate anyone, or create more than one captain account.
  • Send trip requests you don’t mean, flood a captain with requests, or use Yott to send messages unrelated to a trip.
  • Scrape, copy or republish Yott’s content or captains’ listings, or interfere with how Yott works.
  • Harass anyone or break any law.

9. Risks of boating and fishing

Boating and fishing carry real risks, including serious injury and death, that no one can remove. The captain is responsible for the safety and conduct of the trip. Yott makes no promise about the weather, the catch, the vessel or how any trip will go.

10. Email and text messages

Yott emails you about your trip requests, your account and, for captains, your documents. Captains on our outreach list can unsubscribe from marketing email at any time with the link in the email or at getyott.com/unsubscribe. Text messages are sent only to someone who turns them on and confirms the number with a code, and only for updates about their own trip requests or listing; reply STOP to any text to stop.

11. Disclaimers

Yott is provided as is. To the fullest extent the law allows, we make no warranties, express or implied, about the Platform, any captain, any vessel or any trip, including the conduct, qualifications or performance of any captain.

12. Limits on Yott’s liability

To the fullest extent the law allows, Yott is not liable for injury, death, loss or damage arising from a trip or from a captain’s acts or omissions, because Yott does not operate vessels or provide charters. For any claim relating to the Platform itself, Yott’s total liability is limited to the greater of the fees Yott earned on the booking at issue or $100, and Yott is not liable for indirect, incidental or consequential damages. Some of these limits may not apply to you under Florida or maritime law.

13. Your responsibility to Yott

You agree to indemnify and hold Yott harmless from claims, losses and costs (including reasonable attorneys’ fees) that arise from your use of the Platform, your trip, or your breach of these terms. An adult who books for or brings a minor also agrees to indemnify Yott and the captain against claims brought by or on behalf of that minor.

14. Suspending or closing accounts

We may suspend or remove a listing or account for breaking these terms, abuse, safety concerns, lapsed captain documents, or repeated avoidable cancellations. Decisions like that are made by a person, and you can ask us to look again.

15. Law and disputes

Florida law governs these terms, along with U.S. maritime law where it applies. How disputes are heard (court or arbitration) and where will be set in the final version of these terms.

16. Changes

We may update these terms. We’ll post the new version here with a new date and, for material changes, tell account holders. Continuing to use Yott after that means you accept the new terms.
